Software EULA

This agreement governs your use of software products published by NetworkDLS ("the Software"). By downloading, installing, or using the Software, you agree to be bound by the terms below. If you do not agree, do not use the Software.

Open Source Software

Most of the Software published by NetworkDLS is open source and released under the MIT License (or another permissive open source license). Where a project carries an explicit license - stated on its project page and in its source repository - that license governs in place of this Agreement, and you may use, modify, and redistribute that project subject to the terms of that license.

Always check the specific project page or accompanying LICENSE file to confirm which terms apply to a given product.

Proprietary Software

For any Software distributed under proprietary (non-open-source) terms, the following applies:

• You receive a personal, non-exclusive, non-transferable license to use the Software for your internal purposes.
• You may not distribute, rent, lease, sublicense, or make the Software available to third parties except as expressly permitted in writing.
• You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Software, except where this restriction is prohibited by applicable law.
• You will use reasonable efforts to prevent unauthorized access, disclosure, or use of the Software.

Encryption Compliance

Some of the Software uses strong encryption methods that are subject to import, export, and use restrictions in certain jurisdictions. You are solely responsible for verifying that you are authorized to acquire, use, and operate this Software in your location before doing so.

No Guarantee of Safety or Privacy

Although some of the Software employs encryption, NetworkDLS does not guarantee the safety, security, confidentiality, or privacy of your data to any extent. You use the Software at your own risk and take responsibility for protecting your own information.

Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. NETWORKDLS DOES NOT WARRANT THAT THE SOFTWARE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NETWORKDLS SHALL NOT BE LIABLE FOR ANY SPECIAL, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST REVENUES, LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATING TO YOUR USE OR INABILITY TO USE THE SOFTWARE, WHETHER BASED ON CONTRACT, TORT, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Termination

You may terminate this Agreement at any time by uninstalling the Software and destroying or erasing all copies in your possession. This Agreement terminates automatically if you breach its terms. Upon termination, you must destroy or erase all copies of the affected Software. Sections 3, 4, 5, and 6 survive termination.

Changes

NetworkDLS may update these terms from time to time. Continued use of the Software after changes are posted constitutes acceptance of the revised terms. Nothing in this page represents a commitment regarding future versions of the Software, and NetworkDLS assumes no responsibility for errors or omissions in these materials.
